This measure will allow completed conformity assessment activities for CE marking undertaken before the end of 2022 to be valid for manufacturers to use as a basis for UKCA, for the duration of the certificate issued or until 31 December 2027 (whichever is shorter). It will also allow ongoing activities related to that completed conformity assessment activity (e.g. annual inspections) to continue for the duration of the certificate issued or until 31 December 2027 (whichever is shorter).
The measure will also extend current legislation allowing importer information and the Great Britain conformity marking (generally UKCA) to be added to products using a label or accompanying document, rather than being physically marked on the product itself, until 31 December 2025.
These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2019 (c.16) in order to address deficiencies arising from the withdrawal of the United Kingdom from the European Union. The Regulations extend to England and Wales and Scotland only. Regulation 2(1) extends the period during which conformity markings can be placed on a label affixed to, or a document accompanying, the product itself from 36 months to five years from IP completion day. Regulation 2(2) extends the period during which information identifying an importer can be set out in a document accompanying the imported product from 24 months to five years from IP completion day. Regulations 2(3) to 2(5) extend the period during which products in relation to which manufacturers have taken steps to meet EU requirements may be lawfully placed on the market in Great Britain from a period of 24 months to five years from IP completion day if those steps were taken before 31st December 2022 and subject to conditions relating to the continued validity of certificates issued in respect of those requirements and a cut-off date of 31st December 2027, after which the provision is to cease to have effect which the provision is to cease to have effect.
